In a significant move, the Supreme Court of Pakistan has taken strong action to ensure the protection of journalists. The court has reopened a long-pending case concerning violence and threats against media professionals. Additionally, the court secured a major assurance from the government to respect press freedom. This decision marks a turning point for the safety of reporters in the country.
Court Directs Investigations into Attacks on Journalists
The case began in 2021 when five journalists filed a complaint about attacks and abductions targeting media persons. However, the matter remained unheard for a long time. Now, the current bench, led by Chief Justice Qazi Faez Isa, has actively revived the case. The court confirmed that most complainants still seek justice. For example, journalist Asad Ali Toor stated that his attackers claimed to belong to a federal intelligence agency. He also expressed dissatisfaction with the investigation into his case. Therefore, the court has ordered the Attorney-General to submit detailed reports on each case within two weeks. These reports must clarify the status of investigations and whether any charges were filed. The court also emphasized that investigation officers must have full access to all relevant individuals and must not face any obstacles. This directive aims to strengthen journalist safety and ensure accountability.
Government Assures No Action Against Honest Criticism
During the hearing, journalist associations raised another serious issue. They reported that the Federal Investigating Agency (FIA) had been issuing notices to journalists under the pretext of protecting the judiciary from malicious criticism. The journalists feared arrest when responding to these notices. In response, the Attorney-General provided a crucial assurance on behalf of the government. He stated that honest criticism of court judgments is not a crime. Moreover, he promised that no coercive action would be taken against journalists for expressing their opinions. This assurance reinforces press freedom and acts as a legal shield for journalists.
Founder’s Vision Quoted to Uphold Press Freedom
The Supreme Court also recalled the words of Pakistan’s founder, Quaid-e-Azam Muhammad Ali Jinnah, to underline the importance of a free press. The court referred to a past judgment where the Quaid urged journalists to be “fearless” and responsible. He described the power of the press as a “great trust” and welcomed honest criticism. By invoking this vision, the court highlighted that safeguarding journalists and upholding media protection align with the nation’s foundational values.
A Continued Push for Justice and Fundamental Rights
The Supreme Court has further involved the Supreme Court Bar Association (SCBA) in this matter, as it concerns fundamental rights. The SCBA president has agreed to assist the court in these proceedings. With the next hearing scheduled, the judiciary continues its focus on delivering justice and ensuring the protection of journalists. This case represents a hopeful step toward accountability and journalist safety in Pakistan.
