A recent Peshawar High Court decision clearly explains the heavy legal responsibility drivers carry. The police then conducted a search of both the men and the car. This search led to two critical finds. First, they discovered an illegal pistol on Tipu Sultan. More significantly, however, they uncovered 3,600 grams of charas carefully hidden inside secret compartments of the car.

The judge stated that Muhammad Saqib, as the driver, was prima facie connected to the crime. This logic was the core reason the court ultimately decided to deny bail for the driver.

A Different Outcome for the Passengers

In contrast, the court took a very different view of the passengers’ roles. Since Tipu Sultan and Aslam Khan were merely occupants and not in control of the vehicle, the court found a weaker link to the narcotics. Consequently, the judge granted them bail, requiring them to post substantial bonds for their release.
