This Special Power of Attorney is executed on this 11th day of November, 2024, by Mr. Ali, son of Mr. Muhammad, presently residing at Central London, United Kingdom, hereinafter referred to as the Principal, with respect to Civil Suit No. ____ of ____ currently pending adjudication before the Honorable Court of __________ in Peshawar, Pakistan (hereinafter referred to as the said suit).
WHEREAS the Principal is the lawful owner of a 10 marla residential property situated at Saddar Bazar, Peshawar (hereinafter referred to as the subject property), and is presently unable to personally attend court proceedings and related legal forums due to his residence abroad in London;
AND WHEREAS the subject property has been allegedly occupied unlawfully by the Principal’s cousin, Mr. Shahzeb, son of Mr. Sohail, a resident of Saddar Bazar, Peshawar, thereby necessitating legal action to protect the Principal’s property rights and interests;
NOW THEREFORE, the Principal does hereby nominate, appoint, and constitute Mr. Muhammad Amin, Advocate, as his true and lawful Attorney (hereinafter referred to as the Attorney) for the purposes set forth hereunder, conferring full power and authority to act on behalf of the Principal in all matters relating to the said suit, as follows:
- To Appear and Represent: To appear on behalf of the Principal and to act as his lawful representative in all proceedings related to the said suit before the Honorable Court or any other judicial or quasi-judicial forum where the matter may be transferred or referred.
- To Engage Legal Representation: To engage, retain, and instruct solicitors, advocates, counsel, pleaders, or other legal practitioners, as deemed necessary, for the conduct, prosecution, and furtherance of the said suit, including, but not limited to, filing, pleading, arguing, and otherwise managing all legal proceedings.
- To Conduct Proceedings and Execute Documents: To initiate, continue, and conclude all legal proceedings on behalf of the Principal; to prepare, sign, verify, and submit all necessary plaints, written statements, petitions, affidavits, applications, and other legal documents and pleadings; and to produce and adduce evidence as required.
- To Deposit, Withdraw, and Receive Monies and Documents: To deposit or withdraw sums of money as required, and to receive documents, records, or any monies, awards, or judgments from the Court or defendant in execution of a decree or by way of settlement, and to provide proper receipts, releases, and discharges for the same, binding the Principal.
- To Inspect Records and Obtain Certified Copies: To apply for inspection of case records, to review all pertinent documents, and to obtain certified copies or extracts of judgments, orders, and other relevant documents from the Court or relevant authorities.
- To Compromise or Settle the Suit: To enter into negotiations and, if deemed prudent, to compromise, settle, or amicably resolve the said suit in any manner deemed fit and in the best interests of the Principal, including signing and executing all necessary agreements, terms of settlement, or withdrawals.
- To Perform All Acts Necessary for Suit Conduct: To perform, execute, and complete all acts, deeds, and things necessary or incidental to the conduct, management, and resolution of the said suit, with the same force and effect as the Principal himself could if personally present.
The Principal hereby undertakes to ratify, affirm, and confirm all lawful acts done, or caused to be done, by the Attorney under and by virtue of this Special Power of Attorney, binding himself, his heirs, executors, administrators, and legal representatives to such acts as fully as if they had been performed by the Principal himself.
