Second, the wrong officer made the arrest. The law requires a Sub-Inspector to seize narcotics. However, an Assistant Sub-Inspector conducted this recovery. Therefore, the entire process was illegal from the start.

Finally, the trial was not moving forward. The accused was in jail but not needed for more questioning. With no trial in sight, his right to a speedy trial was violated.
